You must never use another person’s account without permission or allow another user to use your profile. You may not create more than one profile.
GoWish reserves the right, at its sole discretion, to limit, suspend, or exclude you from your profile and/or your access to all or part of your profile.
GoWish also reserves the right to change the Services at any time without justification, with or without prior notice. This also means that GoWish may, without notice and at its own discretion, delete services and features within the Services, including wish lists and user profiles. Similarly, GoWish reserves the right to discontinue the Services either with prior notice or immediately.
As a user, you must ensure that you only use the Services for lawful purposes and activities. Specific prohibited activities include, but are not limited to: criminal activities or terrorist activities, harassment, bullying, or any other use that is incompatible with GoWish.
Any action or omission by you in violation of the above prohibitions may result in the termination or suspension of your profile and your access to the Services.

5. AGE OF USERS

s a user, you must be at least 15 years old to create your own profile. GoWish requires users to verify their own age. This means that you must provide your date of birth. GoWish is not responsible if a profile is created in violation of the applicable age limit.
The services are not intended for use by children under the age of 15 without prior parental consent. If you are a parent of a child under 15 and believe that your child has provided personal data without your approval, you are requested to contact us immediately by email at: mail@GoWish.dk, and we will delete the information from our system.
GoWish has developed Kids Account. Kids Account is a special type of profile created by a parent or guardian within an existing user profile. The purpose is to provide children with a safe and independent environment to create and manage wish lists.
Kids Account is linked to a parent’s/guardian’s main account, which can be managed by the parent. The parent grants the child access to a simplified and age-appropriate version of the service. Parents have full control over the Kids Account.
Kids Account is designed to comply with applicable legislation and to support healthy digital habits for children.
The child can, among other things:
create, edit, delete, and rearrange wishes
create, edit, archive, and delete wish lists
customize their profile with a profile picture, cover images, and wish list covers
access the Gift Generator, limited to the child’s registered age
share wish lists via link, SMS, email, and QR code
The child cannot:
share their profile (only wish lists can be shared)
share individual wishes directly
access social features
see advertisements or other recommendations
GoWish does not use children’s data for behavioral marketing and does not share children’s personal data beyond what is necessary to operate the platform.
GoWish does not use children’s data under the age of 18’s personal data for tracking, retargeting or profiling behavioral advertising 
6. MARKETING ON THE PLATFORM
When you create a user account with GoWish and subsequently use the Services, you accept that marketing content may be displayed within the Services. Such marketing may include:
Marketing of GoWish and GoWish’s services, such as special offers from GoWish or new services offered by GoWish.
Marketing of GoWish’s partners and their products, services, etc. that you have listed on your wish list, as well as marketing of our partners’ products and services that are similar to or otherwise related to the wishes you have added to your wish list. This may include products within the same product category or products that otherwise complement the wishes you have fulfilled via your wish list.

If GoWish intends to use additional personal data based on consent, we will request your consent in connection with our cookie consent.

7. NEWSLETTER

When you sign up for GoWish’s newsletter, you accept and consent to GoWish sending newsletters to the provided email address and push notifications, and that these newsletters may contain marketing of GoWish and our partners. You can always view our partners on our website or via this link.
You therefore consent to GoWish sending you emails and push notifications with relevant products, offers, competitions, news, practical information, etc. Marketing in the newsletters will typically include inspiration for your wish list from other products, birthday offers and discounts, new products from our partners, and more.
When signing up for the newsletter, you will be asked to provide your email address as well as your name and postal code so that GoWish can send you newsletters with as relevant inspiration, products, and offers as possible from our partners.
You may withdraw your consent and unsubscribe from the newsletter at any time. Unsubscribing can be done via the unsubscribe link in the newsletter or via your profile under “Account”.
You can read more about the processing of your personal data in GoWish’s Privacy Policy here. You must be over 15 years old to receive the newsletter.

8. RIGHTS

The intellectual property rights and marketing rights to the Services and associated systems/software and materials in the Services belong to GoWish ApS (or third parties). You therefore assume full responsibility for any infringement of such rights originating from your account and/or profile.
You assume full responsibility for the materials and information you use, upload, or submit through the Services, including ensuring that such materials and information comply with applicable law, general morals, codes of conduct, and ethics.
By accepting these Terms of Use, you are granted a non-exclusive and non-transferable right to use the Services for private use on a device you own or control, in accordance with these Terms of Use. GoWish does not guarantee a specific service level or specific functionality of the Services.
GoWish can transfer its rights and obligations relating to the Services to a third party at any time and at the sole discretion of GoWish. 

9. LIABILITY

The Services are provided as they are and are used on your own initiative, as you have the right to opt out of using the Services at any time.

Furthermore, GoWish provides no support and does not guarantee maintenance in connection with the Services. GoWish means all upgrades, updates and changed versions of GoWish.

GoWish cannot be held liable for delays or defects of any kind in relation to the goods or services that you purchase through third parties, including when linking to the third party from a wish list, as GoWish is not a party to the agreement between you and the third party. You cannot assert against us any other rights of default in respect of purchases via third parties.

GoWish is not liable for damages and/or not liable for any personal injury or damage to property that occurs as part of the use of our services or when purchasing via third parties. In any case, our liability for damages is limited to DKK 10,000 for each event.

10. COMMISSION

Partners with whom we have a contractual relationship may be highlighted on the platform under headings such as “trending”, “suggested brands”, “popular products”, and “found on other shops”. Such highlighting will be marked as “sponsored” or “advertisement”, meaning that the partner has paid to be displayed there.
You may add links to third-party websites in your wish list and thereby choose which links appear in your wish list.
Products from retailers with whom GoWish has entered into partnerships may appear when using the wish list, gift generator, or search functions. As these partnerships do not include promotion through these features and do not influence how results are displayed, such displays are not marked as advertising. However, it will be stated on each product page whether the product is an advertisement. Any special promotion of specific products will be marked as “sponsored”.
In some cases, GoWish receives a commission from third parties if you click on or make a purchase via a link in a wish list. It is not always possible for GoWish to know this in advance, as GoWish’s supplier determines in real time whether a commission opportunity exists.

11. SEARCH FUNCTIONS

Our search function dynamically sorts results based on the wording of your search and the relevance of available products at the time of the search. Ranking is primarily influenced by factors such as keyword matching, product title and description relevance, product availability, and recent popularity signals derived from interactions on the platform. If multiple results are substantially similar in relevance, results may be reordered to improve user experience and source diversity.
Search results may include products from retailers with whom we have partnership agreements. Such partnerships do not determine or alter the order in which results are displayed in the search function, and any special promotions for specific partners or products will be clearly marked as “sponsored”, “advertisement”, or “ad” where relevant. Sponsored placements differ from organic search results and are not ranked by our relevance systems.
You may add links to third-party websites in your wish lists, and such links may appear in search results when they match your search. Purchases from third parties are outside our control and subject to the third party’s terms.
We may change, suspend, or remove search features at any time, with or without notice, including adjustments to how ranking signals are weighted or evaluated, in order to maintain or improve service quality.

12. LINKS AND THIRD PARTIES

The Services may contain links to or enable access to websites, apps, or services operated by third parties, including advertisers, partners, or retailers. These third parties are outside GoWish’s control, and GoWish does not monitor or control the content, availability, or functionality of such websites.
By following a link or interacting with a third-party service, you do so at your own risk. GoWish is not responsible for the accuracy, completeness, timeliness, reliability, or quality of such third-party products, services, or information.
When accessing third-party websites, your Personal Data is no longer processed by GoWish as data controller. Such third parties may have their own policies regarding the processing of Personal Data, including payment information, over which we have no control. You are encouraged to review the relevant third-party privacy policies before making purchases or providing information.
All matters relating to purchases, payment, warranty, delivery, maintenance, and other conditions of products or services ordered from third parties are solely between you and the relevant third party. GoWish is not a party to such agreements and assumes no responsibility for them.
GoWish reserves the right to remove links to or from third-party websites without notice. You hereby waive any claims against GoWish regarding third-party content, practices, or data processing.

13. NON-COMMERCIAL USE

The Services are for your personal use only and may not be used in connection with commercial activities, except those specifically approved by GoWish. To become a Partner with GoWish, you may contact our Partner team at partner@gowish.dk.
14. PERSONAL DATA
Information about the processing of your personal data in connection with GoWish and your rights under applicable data protection laws can be found in GoWish’s current Privacy Policy.
The Services may link to external websites outside our control, such as those of our advertisers and partners. GoWish’s Privacy Policy only covers how we process the Personal Data and usage data collected through our Services.
When accessing external websites, your Personal Data will no longer be processed by GoWish as data controller. Please note that external sites may have different policies regarding the collection, use, and disclosure of your Personal Data, including specific policies governing how they process and store your credit card information. GoWish has no control over and is not responsible for such third-party privacy practices. You are therefore encouraged to review the privacy policies of all third-party websites. Cookies accepted on third-party websites are likewise outside GoWish’s control.

15. CHANGES

GoWish may make changes to these Terms of Use if relevant.
Non-material changes to your disadvantage will be notified by email no later than one month before they take effect. By continuing to use GoWish or the Services after the changes take effect, you accept the amended Terms of Use.
If you do not accept the Terms of Use or any changes thereto, you may delete your user account and thereby cease using the Services. You may delete your account at any time via your profile under “Account”.
If we implement material changes to your disadvantage, we will notify you via our Services.
Certain Services within GoWish may be subject to specific terms in addition to these general Terms of Use. In the event of any conflict, such specific terms shall prevail over these general Terms of Use.

16. INDEMNIFICATION

If GoWish is met with claims from third parties arising from or related to your use of the Services in violation of these Terms of Use and/or your breach of these Terms of Use and/or any breach of your representations set out above, and/or if any content you post on the platform causes GoWish to incur liability towards another party, or if GoWish is subject to any claim from an GoWish provider arising from a transaction between you and such provider, you shall indemnify GoWish for all losses and claims incurred.
The above indemnification provisions apply only to the extent permitted by mandatory law.

17. MISCELLANEOUS

These Terms of Use and your acceptance constitute the entire agreement between GoWish and you regarding the use of GoWish and the Services. Our failure to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision.
Section headings in these Terms of Use have no independent legal or contractual effect.

18. GOVERNING LAW

These Terms of Use are governed by Danish law. Any disputes shall be settled by the Danish courts.
To the extent permitted by applicable law, the Danish courts shall have exclusive jurisdiction over any dispute arising out of or relating to your use of the Services, and you agree not to initiate legal proceedings in any other forum.

Disse brugervilkår gælder mellem Ønskeskyen ApS samt dets datterselskaber og tilknyttede selskaber (samlet benævnt “Ønskeskyen”, “vi”, “os” eller “vores”) og dig som bruger af vores tjenester, herunder www.GoWish.dk (“Websteder”), vores mobilapplikation og platform (“Platform”), samt alle steder hvor disse brugervilkår er offentliggjort (samlet benævnt “Tjenesterne”). 
Dit privatliv er vigtigt for os. Derfor henviser brugervilkårene også til vores privatlivspolitik og cookiepolitik, hvor du kan læse mere om, hvordan vi indsamler og behandler dine oplysninger og dit indhold.
Disse brugervilkår er gældende fra 24. Marts 2026.

Ønskeskyen er en gratis platform, der gør det muligt for dig at oprette ønskelister, dele dine lister og købe gaver og varer til de bedste priser online.

Ønskeskyen er gratis for alle brugere. For at kunne bevare Ønskeskyen som en betalingsfri app har Ønskeskyen bl.a. affiliate-aftaler med en række brands, og visse links på Ønskeskyen er affiliate-links. Når du klikker på et affiliate-link og senere foretager et køb fra en af vores partnere, vil Ønskeskyen i visse tilfælde modtage en lille provision af købet. At klikke på et affiliate-link, der genererer en provision, medfører ingen ekstra omkostninger for dig og påvirker ikke kvaliteten af indholdet på Ønskeskyen.

3. BRUGERKONTO

Du skal oprette en brugerprofil til Tjenesterne for at få adgang til at oprette ønskesedler og reservere ønsker. Du kan oprette din konto via e-mail. Du skal være mindst 13 år for at oprette en brugerkonto. 

4. BRUG AF TJENESTERNE 

Når du benytter Tjenesterne, er du forpligtet til at afgive korrekte oplysninger om dig selv og til kun at anvende Tjenesterne til privat, ikke-kommerciel brug.
Ved at benytte Tjenesterne erklærer du, at de oplysninger, du har afgivet, er korrekte.
Dine loginoplysninger er personlige og må ikke deles med andre. Hvis du har mistanke om, at en anden har brugt dine loginoplysninger, skal du hurtigt ændre loginoplysningerne (især adgangskoden) og underrette Ønskeskyen på e-mail: mail@onskeskyen.com.
Hvis Ønskeskyen har begrundet mistanke om, at en anden bruger anvender dine loginoplysninger, er Ønskeskyen berettiget til at annullere dine rettigheder og din brug af Ønskeskyen med tilknyttede tjenester. Du må aldrig bruge en andens konto uden tilladelse eller tillade, at en anden bruger anvender din profil. Du må ikke oprette mere end én profil.
Ønskeskyen forbeholder sig retten til, efter eget skøn, at begrænse, suspendere eller udelukke dig fra din profil og/eller din adgang til hele eller dele af din profil.
Ønskeskyen forbeholder sig desuden retten til at ændre Tjenesterne til enhver tid, uden at dette sker med en begrundelse, hvilket kan ske med eller uden forudgående varsel. Det betyder også, at Ønskeskyen uden varsel og efter eget skøn kan slette tjenester og funktioner i Tjenesterne, herunder ønskesedler og brugerprofiler. Tilsvarende forbeholder Ønskeskyen sig retten til at ophøre med at tilbyde Tjenesterne enten med forudgående varsel eller øjeblikkeligt.
Som bruger skal du sikre dig, at du kun bruger Tjenesterne til lovlige formål og aktiviteter. Specifikke forbudte aktiviteter inkluderer, men er ikke begrænset til: kriminelle aktiviteter eller terroraktiviteter, chikane, mobning eller anden brug, der ikke er forenelige med Ønskeskyen.
Enhver handling eller undladelse fra dig i strid med de ovennævnte forbud kan resultere i vores opsigelse eller ophævelse af din profil og din adgang til Tjenesterne.

5. ALDER AF BRUGERE

Som bruger skal du være minimum 15 år for at kunne oprette din egen profil. Ønskeskyen kræver brugerens egen verificering af alder. Det betyder, at du skal oplyse din fødselsdato. Ønskeskyen er ikke ansvarlig for, at oprettelsen sker i strid med den gældende aldersgrænse. 

Tjenesterne er ikke beregnet til brug for børn under 15 år uden forældres forudgående samtykke. Hvis du er forælder til et barn under 15 år, og du mener, at dit barn har afgivet sine personoplysninger, selvom dette ikke er godkendt af dig som forælder, anmodes du straks om at kontakte os på e-mail: mail@onskeskyen.dk, og vi vil slette oplysningerne fra vores system.

Ønskeskyen har udviklet Kids Account. Kids Account er en særlig profiltype oprettet af en forælder eller værge inden for en eksisterende brugerprofil. Formålet er at give børn et sikkert og selvstændigt miljø til at oprette og administrere ønskelister.

Kids Account er knyttet til en forældres/værges hovedkonto, der kan administreres af forælderen. Forælderen giver barnet adgang til en forenklet og aldersrelevant version af tjenesten. Forældre har fuld kontrol over Kids Account. 

Kids Account er designet til at overholde gældende lovgivning og sikre børns digitale vaner. 

Barnet kan blandt andet:
oprette, redigere, slette og omarrangere ønsker
oprette, redigere, arkivere og slette ønskelister
tilpasse sin profil med profilbillede, coverbilleder og ønskelistecovers
Tilgå Gavegeneratoren begrænset til barnets registrerede alder
dele ønskelister via: link, SMS, e-mail og QR-kode


Barnet kan ikke:
dele sin profil - kun ønskelister
dele individuelle ønsker direkte
få adgang til sociale funktioner
se reklamer eller andre anbefalinger

Ønskeskyen bruger ikke børns data til adfærdsbaseret markedsføring og deler ikke børns persondata, andet end hvad der kræves for at drive platformen. 


6. MARKEDSFØRING PÅ PLATFORMEN

Når du opretter en bruger hos Ønskeskyen, og efterfølgende bruger Tjenesterne, accepterer du, at der fremvises markedsføring på Tjenesterne. Markedsføringen kan indeholde:
Markedsføring af Ønskeskyen samt Ønskeskyens tjenester, f.eks. gode tilbud fra Ønskeskyen eller nye tjenester, der tilbydes af Ønskeskyen.
Markedsføring af Ønskeskyens samarbejdspartnere og de af deres produkter, tjenesteydelser mv., som du har anført på din ønskeseddel, samt markedsføring af vores samarbejdspartneres produkter og tjenesteydelser, der minder om eller på anden vis er relateret til de ønsker, som du har anført på din ønskeseddel. Det kan f.eks. være varer i samme produktkategori ellervarer, som på anden vis supplerer de ønsker, som du har fået opfyldt via din ønskeseddel. 
Du kan læse mere om Ønskeskyens brug af din data til markedsføring i vores privatlivspolitik. 
Såfremt Ønskeskyen vil benytte yderligere persondata, vil vi anmode om dit samtykke i forbindelse med vores cookiesamtykke.

7. NYHEDSBREV

Når du tilmelder dig Ønskeskyens nyhedsbrev, accepterer du og giver samtykke til, at GoWish må sende nyhedsbreve til den oplyste mailadresse og pushbeskeder, og at disse nyhedsbreve må indeholde markedsføring af Ønskeskyen og vores samarbejdspartnere. Du kan altid se samarbejdspartnere på vores hjemmeside eller på dette link. Du giver således tilladelse til, at Ønskeskyen må sende dig e-mails og pushbeskeder med relevante produkter, tilbud, konkurrencer, nyheder, praktisk information m.m. Markedsføring i nyhedsbrevene vil typisk omhandle inspiration til din ønskeseddel fra andre produkter, tilbud og rabatter på din fødselsdag, nye produkter fra vores samarbejdspartnere, m.m. Når du tilmelder dig nyhedsbrevet, bliver du bedt om at oplyse din mailadresse samt dit navn og postnummer, så GoWish kan sende dig nyhedsbreve med så relevant inspiration, produkter og tilbud som muligt fra vores samarbejdspartner. Du kan til enhver tid trække dit samtykke tilbage og framelde dig nyhedsbrevet. Afmelding sker via afmeldingslinket i nyhedsbrevet eller via din profil under “Konto”.
Du kan læse mere om behandlingen af dine personoplysninger i Ønskeskyens privatlivspolitik her. Du skal være over 15 år for at modtage nyhedsbrev.

8. RETTIGHEDER

De immaterielle rettigheder og markedsføringsrettigheder til Tjenesterne og tilknyttede systemer/software og materiale i Tjenesterne tilhører Ønskeskyen ApS (eller tredjepart). Du påtager dig derfor det fulde ansvar for enhver eventuel krænkelse af sådanne rettigheder fra din konto og/eller profil.
Du påtager dig det fulde ansvar for det materiale og de oplysninger, du anvender, uploader eller indsætter i Tjenesterne, herunder at materialet og oplysningerne overholder gældende lovgivning og almindelig moral, kodeks samt etik.
Ved at acceptere disse brugervilkår får du en ikke-eksklusiv ret og ikke-overdragelig ret til at benytte Tjenesterne til privat brug på en enhed, du ejer eller har kontrol over, i overensstemmelse med disse brugervilkår. GoWish garanterer ikke et bestemt serviceniveau eller en bestemt funktionalitet for Tjenesterne.
Ønskeskyen kan overdrage sine rettigheder og forpligtelser i relation til Tjenesterne til en tredjepart til enhver tid og efter Ønskeskyens eget valg.

9. ANSVAR

Tjenesterne, stilles til rådighed, som de er, og anvendes på dit eget initiativ, idet du har ret til, på et hvilket som helst tidspunkt, at fravælge brugen af Tjenesterne.
Ønskeskyen yder desuden ingen support og garanterer ikke vedligeholdelse i forbindelse med Tjenesterne. Ved Ønskeskyen forstås alle opgraderinger, opdateringer og ændrede versioner af Ønskeskyen.
Ønskeskyen kan ikke holdes ansvarlig for forsinkelser eller mangler af nogen art for de varer eller tjenester, som du køber via tredjeparter, herunder når der linkes til tredjeparten fra en ønskeseddel, da Ønskeskyen ikke er part i aftalen mellem dig og tredjepart. Du kan ikke gøre øvrige misligholdelsesbeføjelser for køb via tredjeparter gældende overfor Ønskeskyen.
Ønskeskyen er ikke erstatningsansvarlig og/eller ikke ansvarlig for eventuelle person- eller tingsskader, der opstår som led i brugen af vores tjenester eller ved køb via tredjeparter. Under alle omstændigheder er vores erstatningsansvar begrænset til DKK 10.000 for hver begivenhed.

10. KOMMISSION

De samarbejdspartnere, der har et kontraktmæssigt forhold til os, kan blive fremhævet på platformen under overskrifter som ”trending”, ”foreslåede brands” , ”populære produkter” og ”fundet på andre shops”. En sådan fremhævelse er markeret med ”sponsoreret” eller “annonce”, hvilket betyder, at samarbejdspartneren har betalt for at blive vist dér.
Du kan i din ønskeliste selv indsætte link til websteder, der drives af tredjeparter, og på den måde selv vælge, hvilke links der skal fremgå af din ønskeliste.
Der kan ved brug af ønskelisten, gavegenerator eller søgninger fremkomme produkter fra detailhandlere, som Ønskeskyen har indgået et samarbejde med. Da samarbejdet ikke omfatter promovering gennem disse funktioner og ikke har indflydelse på visningen, er sådanne visninger ikke reklamemarkerede. Det vil dog fremgå på hver produktside, hvorvidt der er tale om annonce. Såfremt der vil være særlig promovering af specifikke produkter, vil det fremgå med “sponsoreret”. 
Ønskeskyen modtager i nogle tilfælde kommission fra tredjeparter, hvis du klikker eller foretager et køb via et link i en ønskeseddel. Det er ikke altid muligt for Ønskeskyen at vide på forhånd, da Ønskeskyens leverandør undersøger i realtid, om der er mulighed for, at GoWish kan modtage kommission. 

11. SØGEFUNKTION

Vores søgefunktion sorterer resultaterne dynamisk på baggrund af ordlyden af din søgning og relevansen af de tilgængelige varer på tidspunktet for din søgning. Rangeringen påvirkes primært af faktorer såsom søgeordsmatchning, varens titel og beskrivelsesrelevans, produktets tilgængelighed og nylige popularitetssignaler, der stammer fra interaktioner på platformen. Hvis flere resultater er væsentligt ens i relevans, kan resultaterne sorteres for at forbedre brugeroplevelsen og mangfoldigheden af kilder.

Søgeresultaterne kan omfatte produkter fra forhandlere, som vi har samarbejdsaftaler med. Et sådant samarbejde bestemmer eller ændrer ikke rækkefølgen af de resultater, der vises i søgefunktionen, og eventuelle særlige kampagner for specifikke partnere eller produkter vil tydeligt blive angivet som "sponsoreret", “annonce” eller "reklame", hvor det er relevant. Sponsorerede placeringer adskiller sig fra almindelige søgeresultater og rangordnes ikke af vores søgerelevanssystemer.

Du kan tilføje links til tredjepartswebsteder i dine ønskelister, og disse links kan vises i søgeresultaterne, når de matcher din søgning. Køb fra tredjeparter er udenfor vores kontrol og underlagt tredjepartens vilkår.
Vi kan til enhver tid ændre, suspendere eller fjerne funktioner i søgefunktionen med eller uden varsel, herunder justeringer af, hvordan rangordningssignaler vægtes eller evalueres, for at opretholde eller forbedre servicekvaliteten.

12. LINKS OG TREDJEPARTER

Tjenesterne kan indeholde links til eller muliggøre adgang til websteder, apps eller tjenester, der drives af tredjeparter, herunder annoncører, samarbejdspartnere eller forhandlere. Disse tredjeparter er uden for Ønskeskyens kontrol, og Ønskeskyen overvåger eller kontrollerer ikke indholdet, tilgængeligheden eller funktionaliteten af sådanne websteder.

Ønskeskyen forbeholder sig retten til at fjerne links fra eller til tredjepartswebsteder uden varsel. Du giver hermed afkald på ethvert krav mod Ønskeskyen vedrørende tredjepartssiders indhold, praksis eller behandling af dine oplysninger.

13. IKKE-KOMMERCIEL BRUG

Du kan finde information om behandling af dine personoplysninger i forbindelse med GoWish og dine rettigheder i henhold til gældende love om databeskyttelse i Ønskeskyens til enhver tid gældende privatlivspolitik her.
Tjenesterne kan linke til eksterne websteder uden for vores kontrol, som f.eks. vores annoncørers og Ønskeskyens andre samarbejdspartnere.
Ønskeskyens privatlivspolitik dækker kun den måde, vi behandler de Personoplysninger og brugsdata, vi indsamler gennem vores Tjenester.
Ved at få adgang til eksterne websteder, vil dine Personoplysninger ikke længere behandles af Ønskeskyen som dataansvarlig. Vær opmærksom på, at de eksterne sider kan have forskellige politikker med hensyn til indsamling, brug og videregivelse af dine Personoplysninger, og at de vil have politikker, der specifikt regulerer, hvordan de behandler og gemmer dine kreditkortoplysninger, hvis du vælger at foretage et køb. 15. ÆNDRINGER

Ønskeskyen kan foretage ændringer i brugervilkårene, hvis relevant.
Ikke-væsentlige ændringer, der er til din ulempe, varsles per e-mail senest en måned før ikrafttrædelsen. Når du benytter Ønskeskyen eller Tjenesterne efter ikrafttrædelsen af ændringerne, accepterer du samtidig de ændrede brugervilkår.
Hvis du ikke accepterer brugervilkårene eller en ændring af brugervilkårene, kan du slette din bruger, og derved stoppe din brug af Tjenesterne. Du kan altid slette din bruger på din profil under “Konto”. 
Hvis vi gennemfører væsentlige ændringer af vilkårene til din ulempe, vil vi oplyse dig om dette via vores Tjenester. 
For nogle tjenester i Ønskeskyen kan der gælde specifikke betingelser ud over disse generelle brugervilkår. For at undgå enhver tvivl har eventuelle specifikke brugervilkår forrang for disse generelle brugervilkår.

16. SKADESLØSHOLDELSE

Skulle Ønskeskyen blive mødt med erstatningskrav fra tredjepart, der skyldes eller opstår som følge af din brug af Tjenesterne i strid med disse brugervilkår og/eller som følge af brud på disse brugervilkår og/eller ethvert brud på dine repræsentationer, der er beskrevet ovenfor, og/eller hvis noget indhold, som du poster på platformen, eller hvis du gennem Tjenesterne påfører Ønskeskyen et ansvar over for en anden, eller hvis Ønskeskyen pålægges ethvert krav fra en Ønskeskyens-udbyder, der opstår som følge af en transaktion mellem dig og en sådan Ønskeskyen-udbyder, skadesløsholder du Ønskeskyen for alle lidte tab og krav.
Ovenstående vilkår om skadesløsholdelse gælder kun i det omfang, at dette ikke strider imod ufravigelig lovgivning.

17. DIVERSE

Disse brugervilkår og din bekræftelse udgør hele aftalen mellem Ønskeskyen og dig om brugen af Ønskeskyen samt Tjenesterne. Vores manglende udøvelse eller håndhævelse af nogen ret eller bestemmelse i disse brugervilkår fungerer ikke som et afkald på denne ret eller bestemmelse.
Afsnitstitlerne i disse brugervilkår har ingen selvstændig juridisk eller kontraktmæssig virkning.

18. GÆLDENDE LOV

Disse brugervilkår er underlagt dansk ret. Eventuelle tvister skal afgøres ved de danske domstole.
I det omfang dette er tilladt under gældende lovgivning har de danske domstole eksklusiv jurisdiktion for enhver tvist, der opstår som følge af eller vedrører din brug af Tjenesterne (og accepterer ikke at indlede nogen retssager i forbindelse hermed undtagen i sådanne domstole).

Protecting your privacy is very important to Ønskeskyen ApS.

This Privacy Policy sets out how we process your personal data ("Personal Data") that we collect from you through your use of our website at Ønskeskyen.dk (the "Website") and the Ønskeskyen platform (the "Platform"), how we will process your Personal Data, as well as when we choose to disclose such Personal Data to third parties. The Website and the Platform are hereinafter collectively referred to as the "Services".

Your use of the Services and submission of Personal Data to us constitutes your confirmation that you have received and read this Privacy Policy. This Privacy Policy is effective as of 1 October 2022.

PERSONAL DATA AND USAGE DATA COLLECTED BY US
If you choose or have chosen to create a profile at Ønskeskyen, we collect the following personal data about you:

name, e-mail address, physical address, telephone number, date of birth, gender, details of events for which you are creating a wish list (e.g. birthday date and location), your family relationships and their contact details, provided by you.

We also collect data on your use of our Services, including information about what requests you enter via the Services and whether your requests are reserved or not. 

Special categories of Personal Data are not collected and processed.

SOURCES AND FREE WILL
We only collect the personal data about you that you choose to give us, either directly or indirectly. 

When we collect Personal Data directly from you, you give us the Personal Data voluntarily or in order to enter into a contract with us. 
The consequence of not providing us with Personal Data may be that we cannot enter into a contractual relationship with you and that you therefore cannot use our Services. 

If you give consent, or if you have given consent, you have the right to withdraw it. If you withdraw your consent, however, this withdrawal will not affect processing prior to withdrawal of consent. 

You guarantee and warrant that all Personal Data and other information that you give us is true and correct and relates to you and not to any other person or company.

USE OF THE PERSONAL DATA WE COLLECT
We collect and use your Personal Data for the following purposes:

	•	To activate or deactivate your subscription to the Services,
	•	To provide the Services to you,
	•	To process your enquiries,
	•	For the purposes of research and development to expand and improve the Services (e.g. using data analysis), to develop new services and solutions and to improve the current Services or to develop new ones,

	•	displaying marketing in the Services.
Marketing may, for example, contain:
	•	Marketing of Ønskeskyen as well as news about Ønskeskyen's services, e.g. special offers from Ønskeskyen or new services offered by Ønskeskyen. 
	•	Marketing of Ønskeskyen's partners and those of their products, services etc. that you have listed on your wish list. The marketing may also include marketing of our business partners' products and services that are reminiscent of or otherwise related to the wishes that you have listed on your wish list. These could, for example, be items in the same product category, or they may be items that otherwise supplement the wishes that you have fulfilled via your wish list, the products that you have added to your wish list, as well as products that are related to your wishes. 
	•	Usage data can be used by us for administrative, analytical, research, testing, optimisation and other purposes
	•	Usage data may be shared in aggregate, anonymous form with third parties that provide analytical services, searches and other optimisation services. This usage data will not be linked to you personally.

WHAT IS THE LEGAL BASIS FOR OUR USE OF YOUR PERSONAL DATA?
We collect and process Personal Data on the following legal basis:

	•	Necessary to fulfil our agreement with you, cf. GDPR Article 6(1)(b)
	•	We generally process your Personal Data if this is necessary for us to fulfil the agreement through which you subscribed to the Services.

	•	Our legitimate interests, cf. GDPR Article 6(1)(f)

Where applicable, we process your Personal Data if this is required to pursue our legitimate interests in connection with the provision of the Services, provided that our interests do not outweigh your interests, rights or freedoms (e.g. your rights to the protection of privacy). We process Personal Data for purposes such as:

	•	Where relevant, to enable you to share certain Personal Data with others,
	•	To carry out research and development to expand and improve the Services, to develop new mobility solutions and to improve the performance of Ønskeskyen's products and services. In this context, we may process your Personal Data in a form that cannot be directly traced back to you,
	•	In order to improve our Services (e.g. if there is a technical problem with the Services), we may use your Personal Data to try to resolve this issue.
	•	In order to send you marketing material that you have given prior consent to receive in accordance with Section 10(1) of the Danish Marketing Practices Act.
	•	To market our Services and our business partners and their products (when consent under data protection legislation is not required), and
	•	To process or disclose your Personal Data when required by law, when demanded of us by law enforcement agencies or the courts, or when necessary for the purposes of establishing, defending or asserting a legal claim.

	•	Our legal obligations, cf. GDPR Article 6(1)(c)
	•	We process your Personal Data if this is necessary for us to comply with our legal obligations, including compliance with decisions made by courts or public authorities.

	•	Based on your consent, cf. GDPR Article 6(1)(a) and, where relevant, Section 13(1) of the Data Protection Act
	•	In certain cases, we only process your Personal Data if you have given your prior consent. For example, we need your prior consent to share your personal data with third-party providers of value-added services. 
	•	We also obtain your consent to share your Personal Data with third parties who, in cooperation with us, market our services and our partners as well as their products.

DISCLOSURE OF YOUR PERSONAL DATA THAT WE COLLECT
We share your Personal Data with others for the following purposes:

	•	We may sell and transfer aggregate usage data, but such usage data cannot identify you as a specific individual.
	•	Ønskeskyen delivers advertisements for banner advertising in collaboration with its partners. This may involve disclosing your Personal Data to third parties who market our Services or our business partners and their products. 
	•	we may disclose your Personal Data if required by law or court order, if the data relates to actual or threatened harmful conduct, to investigate and/or take action against illegal activity, suspected abuse or unauthorised use of the Platform, or to protect others' property or security.
	•	where we are required by public authorities (e.g. law enforcement agencies) and courts to disclose your Personal Data to them,
	•	if reasonably necessary in connection with a dispute in which we are or may become involved, we may share your Personal Data, for example with the other party or parties involved in the dispute or with a court,
	•	we will, if possible, anonymise your Personal Data and then share this anonymised data with third parties for legitimate purposes, e.g. for the development of new mobility services and solutions.
	•	In connection with any sale of our business or any business sector (including associated assets), customer data is generally one of the transferred business assets, and such customer data (including your Personal Data) may then be transferred or sold to the acquirer of our business or part thereof in the event of any such sale or disposal of part or all of our business.

USE OF DATA PROCESSORS
As part of being able to provide Ønskeskyen's service, we collaborate with data processors. We have entered into a data processing agreement with all such companies. For example, we use services from third parties who act as data processors for us. Such third parties have limited access to your Personal Data, to be used for specific internal purposes. These purposes may include marketing assistance, customer service and data analysis. The third parties we have contracted with for such purposes will only be permitted to use your Personal Data for the purposes for which the party has been instructed and will be contractually bound by a data processing agreement.

HOW LONG DO WE KEEP YOUR PERSONAL DATA?
We do not store your Personal Data longer than is necessary for the purposes for which it is processed.

We use the following criteria to determine the periods for which we store your Personal Data:

	•	Duration of your subscription to and delivery of the Services,
	•	Our legal obligations to store certain of your Personal Data,
	•	Periods during which a claim can be made by or against us,
	•	The need for us to carry out investigations,
	•	The necessity to use your Personal Data within the framework of current or potential disputes.
	•	After termination or expiration of your subscription to the Services, we will (except in the above cases) either delete your Personal Data relating to your use of the Services, or retain this Personal Data in a form that cannot be directly traced back to you.

Specific usage data is deleted if you have not used the Services during this 3-year period. For the parts of Ønskeskyen where there will only be one use per year, the Personal Data added to your Ønskeskyen profile will only be deleted at your request or according to the criteria we have described above.

WILL MY PERSONAL DATA BE TRANSFERRED TO OTHER COUNTRIES?
Your Personal Data may be processed by us or our service providers in countries outside the EU/EEA.

If your Personal Data is transferred to countries outside the EU or the European Economic Area ("EEA"), we ensure that a necessary transfer basis is established, such that:

	•	The transfer falls within the scope of a decision on necessary guarantees made by the European Commission pursuant to GDPR, Article 45,

	•	Standard contractual data protection clauses, as approved by the European Commission or a data protection authority pursuant to GDPR Article 46(2)(c) or (d) have been entered into, or

	•	That another valid transfer basis is established pursuant to GDPR chapter V. 


YOUR RIGHTS
We ask that you keep the Personal Data you give us up to date and that you correct any Personal Data you have given us by updating your Ønskeskyen profile.

If you wish to review, delete and/or revise the Personal Data we have stored about you, you must update your profile information or, if this is not possible, contact us with your specific request at kontakt@onskeskyen.dk. We reserve the right to maintain an anonymised version of such information.

You are responsible for maintaining the confidentiality of your profile and your login details (including password), and for all activities carried out under your profile and using your login details. In the event that you choose to create a profile with us, you must not share your login information with anyone.

Subject to and with respect to applicable laws, you have certain rights regarding the Personal Data we hold about you in relation to the Services. These rights include the following:

	•	Right to access: You have the right to obtain insight into your Personal Data. You may wish to gain insight into your Personal Data to confirm our use in accordance with applicable data protection legislation.
	•	Right to rectification: You are entitled to have your Personal Data corrected if it is inaccurate or incomplete.
	•	Right to erasure: This is also known as the “right to be forgotten” and, simply put, it enables you to request the deletion or removal of your Personal Data where there is no compelling reason for us to continue using it. Please note that this is not an absolute right, and exceptions apply.
	•	Right to restriction of processing: You have the right to obtain a restriction on the processing or further use of your Personal Data. When processing is restricted, we may still store your Personal Data, but our use of your Personal Data is limited.
	•	Right to data portability: You have the right to obtain and reuse your Personal Data for your own purposes across different services. Please note that this is not an absolute right, and exceptions apply. This right can also only be exercised in certain circumstances and provided that it does not adversely affect the rights of others (for example, it can be used in relation to Personal Data you have given us and that we have processed to fulfil our agreement with you).

PARTNERSHIPS AND EXTERNAL SOURCES
Our platform may link to external websites beyond our control, such as those of our advertisers and Ønskeskyen's other business partners.

This Privacy Policy only covers the way we process the Personal Data and Usage Data we collect through our Services.

When accessing external websites, your Personal Data will no longer be processed by Ønskeskyen as data controller. Please be aware that the external sites may have different policies regarding the collection, use and disclosure of your Personal Data and that they will have policies specifically governing how they process and store your credit card data if you choose to make a purchase. We have no control over and are not responsible for the privacy practices of such third parties. Therefore, you are encouraged to review their privacy policies on all third-party websites.

Notwithstanding anything in the following section, we are not responsible in any way for the actions or policies of any external website, and you hereby waive any claim you may have against us with respect to the processing, use and disclosure of your Personal Data by third-party websites linked to by us.

The Services are not intended for use by children without adult consent. GOWISH TERMS OF USE

1. TERMS OF USE

These terms of use (“Terms of Use”) apply between Gowish ApS and you as a user of our website at Gowish.com (Website) and the Gowish platform (Platform). The Website and the Platform are hereinafter collectively referred to as the Services.

These Terms of Use are deemed accepted by checking the box on the "I accept" button prior to your use of the Services.

Because your privacy is important to us, these Terms of Use also contain references to our Privacy Policy and Cookie Policy, which explain how we collect and use your content and information.

These Terms of Use are valid from 6/6/2024.

3. CONDITIONS FOR USER CREATION AND USE OF THE SERVICES

When you create a user at Gowish and subsequently use the Services, you accept that marketing is displayed on the Services. The marketing may contain:

Marketing of Gowish and Gowish's services, e.g. special offers from Gowish or new services offered by Gowish, or

Marketing of Gowish's business partners and those of their products, services, etc., that you have listed on your wish list, as well as marketing of our business partners' products and services that resemble or are otherwise related to the wishes that you have listed on your wish list. This may, for example, be items in the same product category, or it may be items that otherwise supplement the wishes that you have had fulfilled via your wish list.

4. CORRECT USE

When using the Services, you are required to provide correct information about yourself and to use the Services only for private, non-commercial use.

By using the Services, you represent that the information you have provided is correct.

Your login details are personal and may not be shared with others. If you suspect that someone else has used your login information, you must promptly change your login details (especially the password) and notify Gowish.

If Gowish has reason to suspect that someone else is using your login information, Gowish is entitled to cancel your rights and your use of Gowish and associated services. You must never use someone else's account without permission or allow someone else to use your profile. You may not create more than one profile.

Gowish reserves the right, at its sole discretion, to limit, suspend or exclude you from your profile and/or your access to all or part of it.

Gowish also reserves the right to change the Services at any time without giving a reason, which can happen with or without prior notice. This also means that Gowish can delete services and functions from the Services, including wish lists and user profiles, without notice and at its own discretion. Similarly, Gowish reserves the right to cease offering the Services either with prior notice or immediately.

As a user, you must ensure that you only use the Services for lawful purposes and activities. Specific prohibited activities include but are not limited to: criminal or terrorist activities.

Any act or omission by you in violation of the above prohibitions may result in our termination or rescission of your profile and your access to the Services.

5. RIGHTS

The intellectual property rights and marketing rights to the Services and associated systems/software and material in the Services belong to Gowish ApS (or third parties). You therefore assume full responsibility for any and all infringement of such rights from your account and/or device.

You assume full responsibility for the material and information you use, upload or insert into the Services, including for ensuring that the material and information comply with applicable legislation and general morals, codes and ethics.

By accepting these Terms of Use, you are granted a non-exclusive and non-transferable right to use the Services for private use on a device that you own or control in accordance with these Terms of Use. Gowish does not guarantee a specific service level or any specific functionality for the Services.

Gowish can transfer its rights and obligations in relation to the Services to a third party at any time and at the sole discretion of Gowish.

6. LIABILITY

The Services are provided as they are and are used on your own initiative, as you have the right to opt out of using the Services at any time.

Furthermore, Gowish provides no support and does not guarantee maintenance in connection with the Services. Gowish means all upgrades, updates and changed versions of Gowish.

Gowish cannot be held liable for delays or defects of any kind in relation to the goods or services that you purchase through third parties, including when linking to the third party from a wish list, as Gowish is not a party to the agreement between you and the third party. You cannot assert against us any other rights of default in respect of purchases via third parties.

Gowish is not liable for damages and/or not liable for any personal injury or damage to property that occurs as part of the use of our services or when purchasing via third parties. In any case, our liability for damages is limited to DKK 10,000 for each event.

7. COMMISSION

You agree that Gowish may in some cases receive commission from third parties, including content providers, merchants, advertisers, sponsors, service providers and licensors, when clicking on a link in your wish list in Gowish results in a purchase from such third parties.

8. NON-COMMERCIAL USE

The Services are for your personal use only and may not be used in connection with commercial endeavours except as expressly approved or authorised by Gowish.

9. AGE OF USERS

The Services are not intended for use by children under the age of 13 without prior parental consent. If you are the parent of a child under the age of 13 and you believe that your child has submitted his/her personal data, even if this has not been approved by you as a parent, you are requested to contact us immediately by email: mail@gowish.com and we will delete the information from our system.

10. LINKS

The Services contain links to websites operated by third parties. We do not monitor or control the linked sites and make no representations regarding, and are not liable for, the accuracy, completeness, timeliness, reliability, or availability of any of the content uploaded, displayed, or distributed, or products or services available at those sites. If you choose to access a third-party website, you do so at your own risk. The presence of a link to a third-party website does not constitute or imply our endorsement, sponsorship, or recommendation of the third party or of any content, products or services contained on or available through the third-party website.

We reserve the right to remove links from or to third-party websites.

Gowish is not responsible for content on websites, apps, or other digital platforms to which the Services contain links.

11. THIRD-PARTY SITES

The Platform enables you to order and receive products, information and services from companies that are not owned or operated by us. Purchase, payment, warranty, delivery, maintenance and any and all other matters relating to merchandise, services or information; opinions or advice requested or received from such businesses are solely between you and such businesses and Gowish is not a party to such agreements.

We do not endorse or guarantee such products, information or services and are not liable for the accuracy, completeness, or usefulness (whether the information is provided by us or directly by third parties) or the quality of the availability of such products or services.

We are not a party to or in any way responsible for monitoring transactions between you and third-party providers of such products, services, or information, or for ensuring the confidentiality of your credit card details. All aspects of payment card transactions are handled by third-party payment card processors or third-party merchants themselves. Any separate fees or obligations you incur in your relationship with these third parties are your responsibility and are not part of any fee charged for the Services.

In addition, third parties may require you to create an account with a third-party provider that is not owned or operated by us. Your agreement and understanding with any such third-party service provider is solely between you and such service provider. We will not be a party to or in any way responsible for your agreement with any such third-party provider. Any disputes you may encounter with any such third-party service provider must be resolved solely between you and the service provider.

12. PERSONAL DATA

You can find information about the processing of your personal data in connection with Gowish and your rights pursuant to applicable data protection legislation from time to time in effect in Gowish's Privacy Policy.

13. CHANGES

Gowish can make changes to the Terms of Use if deemed necessary.

You will be notified by e-mail of any non-essential changes that are to your disadvantage no later than one month before they come into force. If you use Gowish or the Services after the changes come into force, you also accept the changed Terms of Use.

If you do not accept the Terms of Use or a change to the Terms of Use, you can delete your user profile and thereby stop your use of the Services.

If we implement material changes to the conditions to your disadvantage, we will request your active acceptance of the conditions.

For some services in Gowish, specific terms may apply in addition to these general Terms of Use. For the avoidance of doubt, any specific terms of use shall prevail over these general Terms of Use.

14. INDEMNIFICATION

Should Gowish be faced with claims for damages from a third party that are due to or arise as a result of your use of the Services in violation of these Terms of Use and/or as a result of a breach of these Terms of Use and/or any breach of your representations described above and/or if any content that you post on the Platform, or if through the Services you impose a liability on Gowish in relation to any other party, or if Gowish is subject to any claim by an Gowish provider arising out of a transaction between you and such Gowish provider, you agree to indemnify Gowish in respect of any and all losses and claims incurred.

The above terms of indemnification only apply to the extent that this does not conflict with mandatory legislation.

15. MISCELLANEOUS

These Terms of Use and your confirmation constitute the entire agreement between Gowish and you regarding the use of Gowish and the Services. Our failure to exercise or enforce any right or provision under these Terms of Use shall not operate as a waiver of any such right or provision.

The section titles in these Terms of Use have no independent legal or contractual force.

16. APPLICABLE LAW

These Terms of Use are subject to Danish law. Any disputes must be settled by the Danish courts.

To the extent permitted by applicable law, the Danish courts have exclusive jurisdiction over any and all disputes arising out of or relating to your use of the Services (and agree not to initiate any legal proceedings in connection therewith except in such courts).

17. NEWSLETTER

When you sign up for GoWish newsletter, you accept and consent to GoWish sending newsletters to the email address provided and push notifications, and that these newsletters may contain marketing from Ønskeskyen and our partners. You can always see our partners on our website or at this <brand_wall>link</brand_wall>. You thus give permission for Ønskeskyen to send you emails and push notifications with relevant products, offers, competitions, news, practical information, etc. Marketing in the newsletters will typically include inspiration for your wish list from other products, offers and discounts on your birthday, new products from our partners, etc. When you sign up for the newsletter, you will be asked to provide your email address, name, and postal code so that Ønskeskyen can send you newsletters with as relevant inspiration, products, and offers as possible from our partners. You can withdraw your consent and unsubscribe from the newsletter at any time. You can unsubscribe via the unsubscribe link in the newsletter or via your profile under account.
